PARTICIPATION IN THE PROMOTION CONSTITUTES YOUR EXPRESS CONSENT TO AND ACCEPTANCE OF THESE OFFICIAL RULES. BY PARTICIPATING IN THE PROMOTION, YOU REPRESENT AND WARRANT THAT YOU MEET THE ELIGIBILITY REQUIREMENTS AS STATED IN THESE OFFICIAL RULES AND ACKNOWLEDGE THAT FAILURE TO MEET ALL ELIGIBILITY REQUIREMENTS WILL RESULT IN YOUR DISQUALIFICATION.  

Please read these provisions carefully as they affect your rights. IF YOU DO NOT AGREE TO THESE OFFICIAL RULES, INCLUDING THESE PROVISIONS, YOU MUST NOT PARTICIPATE IN THE PROMOTION. 

THIS PROMOTION AND THE OFFICIAL RULES SHALL BE CONSTRUED ACCORDING TO AND GOVERNED EXCLUSIVELY BY U.S. LAW. 

  1. Eligibility. The Patient Experience Survey Donation Offer (“Promotion”) is open only to those who are at least eighteen (18) years of age or older and have done work in the field of Healthcare Experience (an eligible “Entrant”). 
  2. Promotion Description. The Promotion shall consist of four (4) separate promotions: one (1) grand prize promotion (the “Main Donation”) consisting of a $500 donation to a charity of choice, plus three (3) additional $50 donations to a charity of your choice (a “Donation”). 
  3. How to Enter. Each Entrant receives one entry for filling out the survey and an additional entry for each eligible referral who fills out the survey (see the Eligibility section above). 
  4. Selection of Winners. Selection of Winners will occur when the survey reaches one thousand (1,000) responders. The Entrant with the most referred entries will receive the Main Donation in their name (see the How to Enter section). The Entrants with the next three (3) biggest referred entry numbers will receive one Donation in their name each. 
  5. Potential Winner Notification. Winners will be notified via email provided in the Survey. 
  6. Limitation of Liability. TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ANY AMOUNT GREATER THAN: (I) THE HIGHEST VALUE OF ANY OFFER IN THIS PROMOTION; OR (II) ANY LOST PROFITS, OR ANY SPECIAL, INCIDENTAL, INDIRECT, INTANGIBLE, OR CONSEQUENTIAL DAMAGES, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH THE PROMOTION, EVEN IF AN AUTHORIZED REPRESENTATIVE OF SPONSOR OR ADMINISTRATOR KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES, AND NOTWITHSTANDING THE FAILURE OF ANY AGREED OR OTHER REMEDY OF ITS ESSENTIAL PURPOSE, EXCEPT TO THE EXTENT A FINAL JUDICIAL DETERMINATION IS MADE THAT SUCH DAMAGES WERE THE RESULT OF SPONSOR OR ADMINISTRATOR’S GROSS NEGLIGENCE, FRAUD, WILLFUL MISCONDUCT, OR INTENTIONAL VIOLATION OF LAW. 
  7. Personal Information. Information collected from Entrants is subject to Sponsor’s Privacy Policy. Sponsor assures that Entrant’s information will be kept confidential in accordance with applicable data protection laws and regulations.
